Grievance Updates
Local 440 recently won our 1st contract grievance arbitration. The arbitrator ruled in our favor that the City can not “bump” anyone from an overtime shift because of a long-term acting position. Back-pay was ordered and the details are being worked out.
You may recall that we agreed to a settlement on our 1st contract grievance concerning the calculations of your regular rate of pay when working “Constant Staffing Overtime.” The Local is still working through the calculation for the regular rate of pay and the accounting for the back-payments owed to many members of the bargaining unit.
We received a ruling for the grievance filed for Fire Alarm Office Constant Staffing Overtime and the arbitrator ruled in favor of the City. The outcome of this ruling is that overtime worked in the Fire Alarm Office will not be considered ECOT therefore overtime hours will be subject to the same rules as Regular Overtime.
The following is a list of the status of our remaining filed grievances:
- Division Chief Closed Loop Overtime – set for arbitration on February 21, 2012
- Apparatus Staffing Overtime paid as ECOT for TCU Football Games -- delivered notice requesting arbitration to the Fire Chief on January 20, 2012
- Fire Inspector Program -- filed a grievance based on the change of working conditions for fire officers assigned to the Operations Division on January 20, 2012
As always, should you have any questions concerning a grievance, or the possibility of a grievance to file, please contact any of your Local 440 E-Board Members including the Grievance Committee Chairman-Mike Skains.

Fort Worth ratifies first-ever labor agreement with Firefighters
Jan 07, 2011 (21:59:00)
April 14, 2010
In November of 2007, the citizens of Fort Worth voted to give collective bargaining rights to their firefighters. One year later, IAFF Local 440 was recognized as the sole and exclusive bargaining agent and negotiations began. After 16 months of negotiations, the membership of Local 440 ratified the tentative agreement on April 3rd. It was approved by the city council and signed on April 13.
The agreement locks down 4-person staffing, current pension benefits and current healthcare benefits (including retiree healthcare). Wage increases are the equivalent of 8 1/4 % over 3 years and include a new Longevity Supplement pay.
